Acknowledgement, Assumption of Risk, Indemnity & Release of Liability

By taking part in travel services with Southern Cape Adventures (Business Info: Garden Route Adventures Pty (Ltd) | 2026/199441/07) I provide indemnity, consent, and acknowledgement of my behaviour relating to these services. By booking these travel services I agree to the following:

1. Permission

I confirm that I have the authority to sign this indemnity on behalf of all guests included in this booking, and I undertake to inform them of the contents of this waiver.

2. Third-Party Service Providers

I acknowledge that Southern Cape Adventures contracts with third-party providers for accommodation and tour activities (e.g., whale-watching). In such cases:

  • I agree to abide by the safety rules and regulations of the specific service provider.
  • I acknowledge that while Southern Cape Adventures selects reputable partners, it is not responsible for the independent acts or omissions of these third-party contractors.

3. Risks

I acknowledge that tour activities organised and implemented by Southern Cape Adventures in which I am taking part can be dangerous and could result in personal injury including fatal injury to myself and/or my dependants: I voluntarily assume all such risks included but not limited to:

  • Maritime Sites: Walking on uneven, slippery, or rocky coastal terrain and climbing steep, narrow stairs in historical lighthouse structures.
  • Wine & Viticulture: I confirm that I am of legal drinking age (18+) to participate in wine tastings. I acknowledge that Southern Cape Adventures encourages responsible consumption and is not liable for incidents arising from over-consumption of alcohol.

4. Medical & Physical Fitness

I confirm that I am in a state of health that allows me to participate in the booked tour. I have disclosed any relevant allergies or medical conditions (e.g., mobility issues) on the booking form.

5. Waiver and Release

I hereby release Garden Route Adventures Pty (Ltd), its members, and employees from any liability for personal injury, illness, or property damage/loss sustained during the tour.

6. Safety Protocols

I warrant that I will follow instructions and rules given by authorised representatives of Southern Cape Adventures and third-party service providers at all times.

7. Emergency Authorisation

I authorise Southern Cape Adventures to seek emergency medical assistance on my behalf if required, with the understanding that all associated costs are my responsibility.

8. Privacy Policy

I acknowledge that Southern Cape Adventures stores personal information to provide travel services. I consent to the privacy policy.
